Who these terms are between
These Terms of Service (the "Terms") are an agreement between you and Aston Gilliland, trading as Jotcal ("we", "us", "our"), covering your use of the Jotcal calendar and productivity application for iOS and Android (the "App") and the backend service behind it (the "Service").
Most of these Terms apply to both apps. Where the platforms genuinely differ, the section is marked with a badge and applies only to that platform:
iOS only Android only
The short version, which the rest of this page states properly: Jotcal is a calendar app you run on your own device. We give you a licence to use it, you agree not to abuse it, purchases are handled by Apple and Google rather than by us, and the weather and calendar data the App shows comes from third parties and can be wrong.
Do not rely on Jotcal alone for anything where a missed or mistaken event would cause real harm. It is a calendar, not a safety-critical system.
Accepting These Terms
By downloading, installing, or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App. If you are under the age of 13, you may not use the App; if you are under 18, you may use it only with the involvement of a parent or guardian who agrees to these Terms on your behalf.
Your Licence to Use Jotcal
We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, for your own personal or internal business use, in accordance with these Terms and with the app store rules that apply to your device.
This is a licence, not a sale. We retain all rights in the App that we do not expressly grant you.
You agree not to:
- Copy, modify, translate, or create derivative works of the App, except as permitted by law that cannot be excluded by agreement.
- Reverse engineer, decompile, or disassemble the App, or attempt to derive its source code, except to the extent that restriction is prohibited by law.
- Rent, lease, lend, sell, redistribute, or sublicense the App.
- Circumvent, disable, or interfere with the free-trial, purchase-verification, or entitlement mechanisms described below — including by tampering with device identifiers, or by falsifying purchase tokens or receipts.
- Use the Service to send automated, excessive, or abusive volumes of requests, or otherwise to disrupt it for other users.
- Use the App to store or transmit anything unlawful, or in a way that infringes anyone's rights or breaches any law that applies to you.
- Use the App to access a calendar account you are not authorised to access.
Your Content
The events, tasks, notes, and handwriting you create in the App are yours. We claim no ownership of them and, as described in our Privacy Policy, they are stored on your device and are never uploaded to our servers. We have no ability to read, recover, or restore them.
That cuts both ways: you are responsible for backing up your own data. Deleting the App, clearing its data, losing the device, or a device fault will lose anything held only in the App. Where you sync to a calendar account, that provider holds its own copy under its own terms; where you do not, no copy exists anywhere but your device.
Free Trial
We may offer a free trial of paid features for the period stated in the App at the time you start it. The trial is offered once per device. As described in our Privacy Policy, trial eligibility is anchored server-side against a device identifier, and on iOS additionally against Apple's DeviceCheck, so that deleting and reinstalling the App does not start a new trial.
We may change, shorten, or withdraw the free trial for future users at any time. If you believe a device has been wrongly marked as having used its trial — for example, a second-hand device — contact us and we will look into resetting it.
Purchases, Subscriptions, and Refunds
Jotcal offers paid features ("Pro", including the Jotcal Live tier) through two purchase types:
- An auto-renewing subscription, which renews for the stated period until you cancel.
- A one-time purchase ("lifetime unlock"), which grants the included features without recurring payment.
Billing is handled by the app store, not by us
All payments are processed by Apple iOS or Google Play Android, under that store's own terms. We never see or handle your payment details. Prices are set per store and per region and may change; a price change to a subscription takes effect only in accordance with the store's rules, which generally require notice and, in many regions, your consent.
Renewal and cancellation
A subscription renews automatically at the end of each period unless you cancel it at least 24 hours before the period ends. Cancel through your store account — iOS Settings → your name → Subscriptions, or the Google Play Store → Payments & subscriptions. Cancelling stops future renewals; it does not shorten the period you have already paid for, and it does not by itself produce a refund. We cannot cancel a subscription on your behalf.
Refunds
Because the store processes the payment, refunds are granted by Apple or Google under their policies, not by us, and we generally have no ability to issue one. Request a refund through Apple's Report a Problem or the Google Play refund process. This does not limit any rights you have under consumer law that cannot be excluded — see Australian Consumer Law below.
What "lifetime" means
A one-time "lifetime" unlock grants the included Pro features for as long as we continue to publish and operate the App, on the platform it was purchased on. It is not a promise that the App or any individual feature will exist forever, and it does not cover features that depend on a third-party service we can no longer obtain (for example, if a weather or maps provider withdraws access). If we discontinue the App, we will give reasonable notice where we practically can.
Entitlement checks
To keep your purchase working across reinstalls, the App sends a purchase token or transaction identifier to our backend, which verifies it with Apple or Google and stores the result. This is described in full under What Our Backend Holds. If verification fails — because a store API is unavailable, or because a purchase cannot be confirmed as genuine — Pro features may be unavailable until it succeeds. We may revoke an entitlement obtained fraudulently or through a refunded or charged-back purchase.
Calendar Accounts and Third-Party Services
The App works with services we do not control. Your use of each remains governed by that provider's own terms and privacy policy, and we are not responsible for their acts, omissions, availability, or accuracy.
- Your calendars. On iOS, the App reads and writes the calendars already configured in iOS, with your permission. iOS On Android, you may connect Google Calendar, Microsoft Outlook, iCloud, or a generic CalDAV server directly. Android
- You warrant that you are authorised to connect any calendar account you connect, and to grant the App the access it requests.
- Sync is two-way and can change your calendar. Events you create, edit, or delete in the App may be created, edited, or deleted in the connected account. Take care: a deletion made in Jotcal is a deletion in your real calendar.
- Weather is provided by Apple Weather and, on Android, fetched via our backend. Maps and place lookup are provided by Apple on iOS and Google on Android.
- Google user data received through Google APIs is handled in accordance with the Google API Services User Data Policy, including its Limited Use requirements.
If a provider changes, restricts, or withdraws its service, the corresponding Jotcal feature may change or stop working. That is outside our control.
Accuracy of What the App Shows
Two things in particular are best-effort and should not be treated as authoritative:
- Weather forecasts are predictions supplied by a third party. They are frequently wrong. Do not rely on them for travel, aviation, marine, agricultural, or any safety-related decision.
- Handwriting and text recognition — including the parsing of dates, times, and titles out of what you write — is automated and will sometimes misread you. Check that an event was created as you intended.
Calendar synchronisation depends on network conditions and on the provider's own systems, and can be delayed or incomplete. The App is a view onto your calendar, not a guarantee about it.
Availability and Changes to the Service
We may add, change, suspend, or remove features, and we may modify or discontinue the Service, at any time. We aim to keep the backend available but do not promise uninterrupted or error-free operation; it may be unavailable for maintenance, for reasons outside our control, or because a dependency has failed. We may impose reasonable rate limits to keep the Service working for everyone.
Intellectual Property
The App, the Service, and the Jotcal name, logo, and design are owned by us and protected by intellectual property laws. These Terms grant you no right to use our name or branding except to refer to the App fairly and accurately.
Feedback
If you send us suggestions, bug reports, or ideas, you grant us an unrestricted, royalty-free right to use them to improve Jotcal, with no obligation to you. Please do not send us anything you consider confidential.
Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures you are entitled to a replacement or refund, and to compensation for any other reasonably foreseeable loss or damage; you are also entitled to have the goods or services remedied if they are not of acceptable quality and the failure does not amount to a major failure. The disclaimers and limits set out below apply only to the extent the law permits, and where we may lawfully limit our liability for a breach of a non-excludable guarantee, our liability is limited (at our option) to resupplying the service or paying the cost of having it resupplied.
Disclaimers
Subject to the section above, the App and the Service are provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted operation. We do not warrant that the App will meet your requirements, that it will be free of defects, or that any data it displays — including weather, recognised handwriting, or synced calendar content — will be accurate, complete, or timely.
Limitation of Liability
Subject to Australian Consumer Law above, and to the maximum extent permitted by law:
- We are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, business, goodwill, or data, however caused.
- In particular, we are not liable for a missed, duplicated, mis-timed, deleted, or unsynced event, for a decision made in reliance on a weather forecast, or for the acts or omissions of a calendar, maps, or weather provider.
- Our total aggregate liability arising out of or relating to the App, the Service, or these Terms is limited to the greater of the amount you paid us for the App in the 12 months before the claim arose, or AUD $100.
These limits apply even if a remedy fails of its essential purpose, and they reflect a reasonable allocation of risk for an app supplied at this price.
Suspension and Termination
You may stop using the App at any time by deleting it. As explained in our Privacy Policy, deleting the App does not delete the trial and purchase records held against your device identifier; to request their deletion, see the Data Deletion page.
We may suspend or terminate your access to the Service if you materially breach these Terms — in particular by tampering with trial or purchase verification, or by abusing the backend. Where the breach is not serious or deliberate, we will give you notice and a chance to fix it first. Sections that by their nature should survive termination — ownership, disclaimers, liability limits, and governing law — do survive it.
Terms Required by AppleiOS only
This section applies only to Jotcal for iOS, obtained through the Apple App Store.
- These Terms are between you and us only, not with Apple. We, not Apple, are solely responsible for the App and its content.
- Your licence to use the App is limited to a non-transferable licence to use it on any Apple-branded device you own or control, as permitted by the Usage Rules in the Apple Media Services Terms of Use.
- Apple has no obligation to provide maintenance or support for the App. Support requests should come to us, at the address below.
- If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are our responsibility.
- We, not Apple, are responsible for addressing any claim by you or a third party relating to the App — including product liability claims, claims that the App fails to conform to a legal or regulatory requirement, and claims arising under consumer protection or privacy law — and for the investigation, defence, settlement, and discharge of any third-party claim that the App infringes intellectual property rights.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance will have the right to enforce them against you as a third-party beneficiary.
Governing Law
These Terms are governed by the laws of New South Wales, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of that state and of the Commonwealth of Australia. If you are a consumer resident elsewhere, this does not deprive you of the protection of mandatory consumer laws of your country of residence.
General
If any provision of these Terms is found unenforceable, the rest remains in force and the unenforceable provision is limited to the minimum extent necessary. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a transfer of the App or our business.
These Terms, together with our Privacy Policy, are the entire agreement between you and us about the App.
Changes to These Terms
We may update these Terms from time to time. Changes will be reflected by updating the "Last updated" date at the top, and where a change materially reduces your rights we will make reasonable efforts to tell you in the App. Continued use of the App after a change takes effect constitutes acceptance of the updated Terms. If you do not accept them, stop using the App.
